These Terms and Conditions (“Terms”) govern your access to and use of avilom.net and any related pages, tools, features, content, applications, smart-contract interfaces, token sale/presale pages, and services (collectively, the “Service”) provided by Avilom (“Company”, “we”, “us”, “our”).
By accessing or using the Service, including participating in any token sale or presale, you agree to be bound by these Terms. If you do not agree, do not use the Service.
IMPORTANT NOTICE: Crypto assets are risky and volatile. Blockchain transactions are generally irreversible. You may lose all funds.
1) Definitions
For purposes of these Terms:

“Token” means the digital token identified on the Service as AVM.

“Token Sale” means any sale, presale, distribution, or purchase process offered through the Service related to the Token, including staged presales, public sales, allocations, claims, airdrops connected to purchases, or similar mechanisms.

“Wallet” means a third-party wallet software or hardware you use to store and control private keys and sign blockchain transactions.

“Smart Contract” means blockchain code that executes transactions and related logic.

“Content” means text, graphics, images, logos, software, code, documentation, and other materials available on the Service.

“You” means the individual or entity using the Service.
2) Eligibility; Your Representations
By using the Service, you represent and warrant that:

You have the legal capacity to enter into these Terms.

You are using the Service for lawful purposes only.

You will comply with all rules, restrictions, and requirements that apply to you.

If you use the Service on behalf of a company or another person, you have authority to bind them to these Terms.

You understand crypto risks, including volatility and the possibility of total loss.
We may refuse access to the Service to any user at any time.
3) Changes to the Service and Terms
We may update these Terms at any time by posting a new version on the Service and updating the “Last updated” date. Your continued use of the Service after changes means you accept the updated Terms.
We may modify, suspend, or discontinue all or any part of the Service at any time, with or without notice.
4) No Advice; No Reliance
The Service is provided for informational and functional purposes only. Nothing on the Service constitutes financial, investment, legal, tax, or accounting advice.
You acknowledge that:

You are not relying on any statement, projection, roadmap, marketing message, or estimate as a promise or guarantee.

Any examples, timelines, or forward-looking statements are aspirational and may change.
You are solely responsible for your decisions and actions.
5) The Token Sale / Presale (AVM)
This Section applies to participation in any Token Sale.
5.1 How purchases work
The Token Sale may require you to connect a Wallet and execute a blockchain transaction through a Smart Contract or other payment flow supported by the Service.
You are solely responsible for:

verifying you are on the official domain (avilom.net),
-
verifying the correct Smart Contract address (from official Company channels),
-
verifying token sale stage terms displayed at the time of purchase,
-
verifying the correct network/chain,
-
verifying wallet address, amount, and transaction details,
-
ensuring you have enough funds to cover network fees.
5.2 Transaction finality; no reversals
Blockchain transactions are generally irreversible. Once you submit a transaction, it may not be possible to cancel, reverse, or recover funds.
5.3 No refunds; no chargebacks
All Token Sale purchases are final. To the maximum extent permitted by applicable rules, no refunds, cancellations, returns, reversals, or chargebacks are available.
This includes, without limitation, purchases impacted by:

mistakes (wrong address, wrong network, wrong amount),
-
Wallet issues (lost keys, hacked wallet),
-
network congestion or delayed confirmations,
-
Smart Contract bugs, exploits, or unexpected behavior,
-
third-party outages or failures,
-
market volatility or token price movements,
-
changes to the Token Sale schedule, stages, or mechanics.
5.4 Allocation, limits, rejection, cancellation
We may set minimums, maximums, caps, per-wallet limits, allowlists, or other restrictions.
We may, in our discretion:
-
reject, pause, delay, or cancel purchases or allocations,
-
block Wallet addresses,
-
limit participation,
-
withhold or delay token delivery,
-
invalidate suspected abusive activity,
-
change Token Sale terms (including stage pricing, timing, caps, bonuses).
5.5 Token delivery; timing; conditions
Token delivery (or claim availability) may occur immediately or later. Delivery may be delayed due to technical, operational, security, or other reasons.
You acknowledge there is no guarantee of any delivery date/time and that delivery may depend on factors such as:

Smart Contract state,
-
network conditions,
-
security reviews,
-
operational readiness,
-
anti-abuse checks,
-
third-party dependencies.
5.6 No promise of value, liquidity, or listing
You acknowledge and agree:
-
the Token may have no value,
-
token markets may be illiquid or nonexistent,
-
exchange listings are not guaranteed,
-
no price, profit, or return is promised,
-
you may be unable to sell or transfer the Token at any time.
5.7 Token utility may change
Any described token utility, features, or roadmap may change, be delayed, be limited, or be discontinued at any time.
5.8 Taxes
You are solely responsible for any taxes, duties, filings, reporting obligations, and accounting related to your purchase, holding, transfer, or disposal of Tokens.
5.9 Compliance checks; verification
We may require additional verification at any time (including identity checks or anti-fraud checks) as a condition of participation or token delivery. If you do not provide required information, we may refuse participation or withhold delivery.
6) Wallets and Smart Contracts
6.1 No custody
We do not take custody of your assets and do not control your Wallet. You are solely responsible for safeguarding private keys/seed phrases.
6.2 Smart Contract risks
Smart Contracts can contain vulnerabilities or behave unexpectedly. You accept the risk of partial or total loss arising from Smart Contract failure, exploit, or unexpected behavior.
6.3 Network risks
Blockchain networks may experience congestion, delays, forks, outages, validator issues, or other events that affect transactions. We are not responsible for such events.
7) Third-Party Services and Links
The Service may integrate with or link to third parties (wallets, explorers, RPC providers, exchanges, analytics, payment providers, hosting, etc.). Third parties may have their own terms and policies.
We are not responsible for third-party acts, omissions, outages, security issues, availability, or losses.
8) Accounts (If Offered)
If the Service allows accounts, you agree to:
-
provide accurate information,
-
maintain the confidentiality of credentials,
-
notify us of unauthorized access.
You are responsible for all actions taken through your account.
9) Acceptable Use; Prohibited Conduct
You agree not to:
-
violate any rule or requirement applicable to you,
-
engage in fraud, deception, or manipulation,
-
exploit vulnerabilities (including smart contract exploits),
-
interfere with or disrupt the Service (scraping, bots, DDoS, malware),
-
attempt unauthorized access to systems or data,
-
impersonate others or misrepresent affiliation,
-
use the Service to launder funds or conceal proceeds of wrongdoing,
-
submit false information to bypass restrictions or checks.
We may suspend or terminate access for suspected violations.
10) Intellectual Property
The Service and its Content are owned by or licensed to the Company and protected by intellectual property rights.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business use, subject to these Terms.
You may not copy, modify, distribute, sell, sublicense, or create derivative works from the Service or Content except with our written permission.
11) User Content (If Applicable)
If you submit content to the Service (messages, posts, feedback, media), you represent you have the rights to do so and that it does not violate any rights or rules.
You grant us a worldwide, royalty-free, sublicensable license to use, host, reproduce, modify, display, distribute, and process that content to operate, improve, and secure the Service.
We may remove content at any time.
12) Privacy
Our Privacy Policy explains how we collect and use personal data. By using the Service, you agree to the Privacy Policy.
13) Disclaimers
To the maximum extent permitted:

The Service is provided “AS IS” and “AS AVAILABLE.”

We make no warranties of any kind, whether express, implied, or statutory, including fitness for a particular purpose, merchantability, accuracy, reliability, non-infringement, or availability.

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

We do not guarantee that any Token Sale will be completed, that tokens will be listed anywhere, or that any roadmap will be achieved.
14) Risk Disclosures
You acknowledge and accept the risks of using crypto services, including:

extreme price volatility and potential total loss,
-
irreversible transactions,
-
smart contract vulnerabilities and exploits,
-
Wallet compromise, phishing, malware, SIM swaps, and key loss,
-
network congestion, forks, or protocol changes,
-
uncertain liquidity and transferability,
-
operational risks, outages, and third-party failures.
You assume full responsibility for evaluating these risks.
15) Limitation of Liability
To the maximum extent permitted, the Company and its affiliates, directors, officers, employees, contractors, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or other intangible losses arising out of or relating to:

your access to or use of the Service,
-
participation in the Token Sale,
-
smart contract or blockchain failures,
-
Wallet issues or third-party services,
-
delays, outages, or security incidents.
To the maximum extent permitted, our total liability for any claim arising from or related to the Service will not exceed the greater of:

€100, or
-
the total fees you paid to us (if any) for the Service in the 3 months before the event giving rise to the claim.
Some limits may not apply in all situations; where they do not apply, liability will be limited to the minimum extent permitted.
16) Indemnification
You agree to defend, indemnify, and hold harmless the Company and its affiliates, directors, officers, employees, contractors, agents, and licensors from and against all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

your use of the Service,

your Token Sale participation,
-
your violation of these Terms,
-
your violation of any rights of any third party,
-
your Wallet transactions and activities.
17) Suspension and Termination
We may suspend or terminate your access to the Service at any time, with or without notice, including if we believe you:

violated these Terms,

pose a security or abuse risk,
-
created legal/compliance risk for the Service.
You may stop using the Service at any time.
Sections that by their nature should survive termination will survive, including: Disclaimers, Risk Disclosures, Limitation of Liability, Indemnification, and Intellectual Property provisions.
18) Dispute Resolution; Venue
If a dispute arises, you agree to first contact us and attempt to resolve it informally.
If not resolved, disputes will be handled in a competent forum determined by applicable procedural rules, unless the parties agree otherwise.
19) Miscellaneous

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement regarding your use of the Service.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver: Failure to enforce any provision is not a waiver.

Assignment: You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

Force Majeure: We are not responsible for delays or failures due to events beyond our reasonable control (including network failures, blockchain issues, outages, attacks, or third-party disruptions).
